Justine Spencer, an associate in the clinical negligence group at Penningtons Solicitors, acted for Liz Austin in a landmark clinical negligence case where she received substantial undisclosed compensation after the death of her civil partner, Tina Lane.
What were the main challenges in this case, and the possible implications? This was a novel claim involving a civil partnership and we were not sure in the early stages if potential new defences, such as longevity of the relationship, would be raised to test this evolving area of law.
Also, Tina had an unusual occupation; she was a shepherdess who, shortly before her death, had planned to go into business with a local entrepreneur. Her deteriorating health prevented the plans from going ahead, and the lack of a finalised formal agreement posed a challenge when trying to secure an appropriate settlement for future loss of earnings.
What was your worst day as a lawyer? Needing a police escort to leave a coroner’s inquest because some highly emotional relatives had threatened to assault the legal team and expert witnesses.
What was your most memorable experience as a lawyer? This is less about one particular case and more related to the enormous sense of satisfaction that I feel when I achieve a good result in any complex clinical negligence claim.
Knowing that an individual or family, with whom I have worked for several years, will now be able to focus on their future, free of any financial worries, is immensely rewarding.
Who has been the most influential person in your life and why? Apart from my husband, Jon, it has been Peter Taylor, a litigation partner in my first training seat. He was a great support in helping me to realise my ambition to become a clinical negligence specialist.
What would your advice be to anyone wanting a career in law? Only consider a career in law if you’re prepared to give 110 per cent. You must enjoy it and be willing to put in the hard work that’s necessary to succeed. The ability to develop a thick skin is another important prerequisite.
If you had not become a lawyer, what would you have chosen and why? A travel writer. For as long as I can remember, I have had a passion for travel and, as anyone who knows me can confirm, I live for my holidays. Otherwise, a test driver for any supercar manufacturer!
Where do you see yourself in ten years? Still saving up for an Audi R8 V10.
