Anna Mills, an associate solicitor in the contentious construction group at Lovells, acted under a conditional fee agreement for a rape complainant who was sued for £300,000 by her alleged rapist after his conviction was quashed. The Court of Appeal, in a landmark decision, ruled that the woman should not be exposed to such an unprecedented legal attack.
What were your main challenges in this case and the possible implications?
Getting to grips with the elements of the tort of malicious prosecution — a far cry from your average construction dispute. We had also to find a way to distinguish our client’s case from a House of Lords’ authority [decision]. If the claim had succeeded any victim of an unwitnessed crime, or any sole witness to a crime who agreed to support a prosecution and give evidence in criminal proceedings, could have been exposed to a claim for malicious prosecution. As a matter of public policy it would be disastrous if victims of rape, or indeed any crime, were deterred from reporting the criminal acts.
What was your worst day as a lawyer?
During a mini-pupillage, before I was called to the Bar, I was observing a trial and was sent off to have lunch by myself. Unfortunately, I got completely lost in the Royal Courts of Justice and could not find my way back to the courtroom. Too embarrassed to walk in late, I returned to chambers, having missed the entire afternoon of the hearing. I learnt an important lesson and now arrive at least ten minutes before everyone else ...
What was your most memorable experience as a lawyer?
Working on this case with an amazing team and a brave and grateful client.
Who has been the most influential person in your life and why?
My parents, for teaching me the value of forgiveness, compassion and integrity. My husband, for reminding me, when the chips are down, that I can do my job, and Roberta Downey, a partner at Lovells, who is an excellent lawyer and a terrific mentor.
Why did you become a lawyer?
I always wanted to be a litigator. For some people it is just in their blood — I am lucky to have found my vocation.
What would your advice be to anyone wanting a career in law?
Work hard, find a firm with a culture that suits you, trust your instincts and learn to let things go — no one is perfect.
Where do you see yourself in ten years?
As a partner at this firm and as a mother who worries about spending too much time at work and not enough at home
